Berry Basket Patterns?

Way back several years ago maybe around 2010 I purchased a large set of patterns from the berry basket.. like 1800 patterns.. anyway... I have a person on etsy asking me for one of the patterns.. I figure it's not my pattern to sell / give away so it's a no from me.. however.. if I could steer the person to a web site or somewhere to get a copy of the pattern she wants.. Is the berry basket patterns still out there somewhere to purchase? This is a desk clock pattern of a dolphin.. see photo of one I made below.

Person claims they have looked for years for the design but haven't be able to find anything.. thought maybe one of you all might know where to get it... besides me, LOL

These were patterns from Rick and Karen Longabaugh. This image is in this book from Fox Chapel publishing.

That was a great deal back then, I don't remember if it was a download or a CD set but it pretty much had all of their designs.

Kevin, if this is one of the patterns that were included in the sale that Rick and Karen Longabaugh  put on when they sold the company, then, you can either give her the pattern, or you can sell it to her. The patterns that were included in that sale, were copyright free and you could do whatever you wanted with them. There was a part of that release that was still copyright protected, but it was only one part and that part was the big clocks. I'm not certain, but I think it was part number four that was protected. I've lost all of those patterns through a computer crash, I wish I hadn't, there was some very  nice patterns.

Well yes.. that is when I purchased the pattern set.. and I thought I had read that these patterns was royalty free but wasn't sure.. I bought back around 2010 I think and the set of 1800+ was around $40 - 60 I think.. maybe more but it was really cheap. While I may just send the pattern to her.. not interested in selling it though.. I also lost a lot of patterns in a computer crash.. and luckily I had backed up these patterns to a disc or I wouldn't have them either.. I now backup to a external drive as well as to disc and another computer LOL..

You cannot sell Berry Basket patterns.

That disc of patterns you purchased were for your own use. Read the agreement.

The international rights to all Berry Basket Scrollsaw Patterns - not in Fox Chapel book - were purchased by Benjamin Jones from Rick and are protected.

All, including the clock pattern mentioned, are now available on scrollsaw.com as either digital PDF download or in a paper format that is mailed to a customer.

I have the full disk of patterns and Paul is 100% correct.. Not ALL patterns are available on that site. I do not sell these but was told "Certain CD's " did have rights to sell them.. I don't know about that and am not chancing it nor would I want to sell any of these anyway.. 

For what it's worth.. there was no agreement within the download that I received with these designs either.. I purchased the "download" not the CD.. you had a option to get it on disc mailed to you or digital download..  almost seems like the disc was also sold out and was only available in the digital format, but anyway rather than wait for a disc I did the download.. maybe the agreement didn't get bundled with the downloaded files? I don't know, I do know they was only available for a very short time before they (Rick and Karen) sold to Benjamin.  

Either way I have not sold any of these and don't intend to. 

P.S. Quoting Len won't get anywhere with him as I don't believe he is with us anymore. He and I communicated quite a lot in PM's and he was pretty rough shape 4 years ago.. I see he hasn't been longed on since 2022.. so I assume he is no longer with us..

 

EDIT: Just wanted to clarify that I did in fact find the Terms within the downloaded files that the patterns are not to be sold etc.. They was in a folder that you would never expect it to be in.. Probably should have had a "Terms of Use" folder so people could find it. I spend a good 40 minutes to find it and actually had to download a program so my computer would even open the odd file.. Now everyone knows..

I'll try to remember that for the next person that might ask me for the pattern.. This post was 7 years ago and I have no idea if the person that messaged me still needs it or even how to find who that person was now.. just some random message I got from Etsy.. for some reason I get people all the time spamming me for access to patterns of items I have made on there..

I too have that pattern and probably have all of Rick's Patterns. remember Rick also had a magazine he sent out as part of a club package and they had patterns in them. Not sure what the rules are with that too. Many of those patterns are nowhere to be found in any books.

Kevin, Len is still around.  He just apparently doesn't visit the village.  He does communicate on "The Scrollers Cafe" Forum.  I saw a post/reply over there from him just yesterday.  He has been through several issues with his health but is still plugging along based on what he has said recently on that Forum.

That is wonderful that he is still around. I don't get out into some of the "other scrollsaw forums" like I used to and although a member of most of them I only check in on them every now and then.
